Legal correspondence, 1940-1948

 File — Box: 19, Folder: 4
Identifier: Series 5

Scope and Contents

From the Series:

This series is closed to public access; it is open only to shareholders of and attorneys for the Reorganized Farmers Ditch Company. This is the largest series in the collection, in part because F. Ray DeGood was both the Farmers Irrigating Ditch and Reservoir Company's secretary/treasurer and its attorney for most of the 1960s through 1980s, and also because of the amount of litigation the company was involved in during later years. Little documentation from before the 1960s exists here. The majority of the files document the Lawn Lake flood litigation and federal reserved water rights litigation concerning the South Platte River Basin (the USA case). Other files contain legal correspondence pertaining to the general operation of the company or other lawsuits, filed either chronologically or by subject. Included in the subject files are three boxes of planning and zoning blueprints showing proposed construction that would effect the ditch, largely in the vicinity of the McWhinney developments at Interstate 25 and U.S. Route 34 and nearby subdivisions.

The correspondence files contain mostly letters, with some documents mixed in, such as easement agreements, board minutes, and annual reports. Once the Reorganized Farmers Ditch Company was formed in 1983, correspondence files for the two companies remained mixed, until 2000 when they become predominantly related to RFD. Much of what is in this series falls under attorney/client privilege. Materials are arranged with chronological correspondence files first, subject files arranged alphabetically by folder title, followed by a set of files each for the Lawn Lake flood and the USA case ( United States v. Colorado, general adjudication case number W-8439-76). The latter two sets contain letters, court orders, briefs, depositions, pleadings, and related documents.
